Welcome to Batao.ai, a referral and loyalty software platform provided by QWIKLY LABS PRIVATE LIMITED ("Batao.ai", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our platform, accessible at https://batao.ai, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.
Batao.ai is designed to help consumer and retail businesses create membership programs and referral programs for their walk-in customers. The platform allows businesses ("Sellers") to reward their customers ("Buyers") in a personalized way through a reward management system, which facilitates repeat business and attracts new customers via rewards and referrals.
Businesses must register for an account to use the Service. Each business is responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

Account Information: When you sign up for an account,
we collect your name, email address, mobile number, and other relevant
contact information.
Program Data: Information related to the loyalty and
referral programs you create, including customer names, emails, purchase
history, and referral details.
Usage Data: We collect information about your
interactions with our services, such as the pages or features you use,
time spent on pages, and other interaction data.
Device Information: We collect information about the
device you use to access our services, including the hardware model,
operating system and version, unique device identifiers, and network
information.
Cookies and Similar Technologies: We use cookies and
similar technologies to collect information about your use of our
services and to provide a better user experience.

Sellers can create and manage membership and referral programs through the Batao.ai platform.
Any discount coupons or offers provided through the platform are issued by the Sellers directly to their customers. Batao.ai is not responsible for the adherence to or redemption of these discounts.
If a Seller denies honoring a valid discount coupon, the issue must be settled mutually between the Buyer and the Seller. Batao.ai is not a party to these transactions and cannot resolve any disputes arising from them.
In case of any legal proceedings due to a dispute between a Buyer and a Seller, Batao.ai will not be added as a party to the case. Both Buyers and Sellers agree to indemnify Batao.ai and its officers and representatives from any costs, damages, liabilities, or other consequences arising from the actions of users of the Service, and specifically waive any claims under any applicable laws of India.
Customers can only avail one offer per bill. Customers cannot club in-house membership offer with Zomato/Swiggy (Dine out) offers.
Offer is valid on all or limited items as decided by the store/outlet. Store/Outlet may decide to revoke offer on a specific item/items at any time.
We do not share customer data with any third parties. Customer data may be used to remind them about their coupons and offers via WhatsApp, SMS, or email.
Customer data may be used to train our AI engines to improve user experiences and provide better recommendations to businesses.
We do not share any business or transaction data of one business with another.
The Seller agrees to a subscription fee-based model to use Batao.ai. The exact fee will be as discussed and confirmed in the proposal email.
If the Seller discontinues or delays payment of the subscription fee for more than 30 days, Batao.ai reserves the right to deactivate access to the Seller portal and user dashboard for that business. Any active coupons or referral discounts given to customers will not be accessible until the account is reactivated upon payment of all pending dues.
We implement a variety of security measures to maintain the safety of your personal information. These measures include encryption, access controls, and regular security audits. However, no method of transmission over the internet or electronic storage is 100% secure, so we cannot guarantee its absolute security.
Account Information: You can update or correct your
account information by logging into your account settings.
Cookies: Most web browsers are set to accept cookies by
default. You can usually modify your browser settings to remove or
reject cookies, but this may affect your ability to use our services.
Marketing Communications: You can opt out of receiving
marketing emails from us by following the unsubscribe instructions in
those emails.
Our services are not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete that information promptly.
Batao.ai is a platform for Sellers to provide membership and referral offers, and for Buyers to avail of these offers. We do not take responsibility for the fulfillment or enforcement of any offers. Batao.ai is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service.
All subscription payments are final, and refunds are not permitted once a payment has been processed. Subscribers have the option to discontinue their subscription at the end of the current billing cycle by choosing not to renew
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
